Terms and Conditions of Sale & Installation

Welcome to Outdoor Play People. These Terms and Conditions govern the sale of goods and the provision of installation services by Outdoor Play People (“the Company”) to you (“the Customer”). By accepting a quotation or placing an order, you agree to be bound by these terms.

1. Quotations and Orders
Validity: All quotations are valid for 30 days from the date of issue, unless otherwise stated in writing.

Acceptance: A contract is formed only when the Company receives written acceptance of the quote and any required deposit.

Specifications: As we specialize in bespoke timber and HDPE equipment, slight variations in natural materials (e.g., timber grain or color) are normal and do not constitute a defect.

2. Pricing and Payment
VAT: All prices are subject to VAT at the prevailing rate.

Standard Terms: Unless otherwise agreed, a 50% deposit is required to secure a manufacturing slot. The remaining 50% balance is due within 7 days of project completion.

Late Payment: The Company reserves the right to charge interest on overdue accounts at a rate of 8% above the Bank of England base rate.

Retention: We do not accept the withholding of "retention fees" unless explicitly agreed in writing prior to the commencement of works.

3. Site Preparation and Access
Access: The Customer must provide clear, unobstructed access to the installation site for vehicles and machinery (between 8:00 am and 5:00 pm).

Underground Services: The Customer is responsible for identifying and marking all underground services (pipes, cables, drains). The Company accepts no liability for damage to unmarked services.

Ground Conditions: Quotations assume "normal" digging conditions. If unforeseen obstructions (e.g., solid rock, buried concrete, or asbestos) are discovered, additional labor and plant costs will be charged.

Welfare: The Customer should provide access to basic welfare facilities (toilets and water) for the installation team where possible.

4. Safety and Compliance
Standards: All equipment is designed and installed to meet BS EN 1176 (Play Equipment) and BS EN 1177 (Impact Absorbing Surfacing) standards.

Post-Installation: Upon completion, the site will be "handed over" to the Customer. It is the Customer's responsibility to conduct regular inspections and maintenance as per the provided manufacturer’s guidelines.

Risk Assessment: The Company will provide a Risk-Benefit Assessment for the installed equipment.

5. Delivery and Installation Timeline
Estimates: Any dates given for delivery or installation are estimates. While we strive to meet deadlines, the Company is not liable for delays caused by inclement weather, material shortages, or third-party logistics.

Aborted Visits: If an installation team arrives but cannot work due to site unreadiness or lack of access, an Abortive Visit Fee will be charged.

6. Title and Risk
Ownership: Legal title to all goods remains with Outdoor Play People until the final invoice is paid in full.

Risk: Risk of loss or damage passes to the Customer upon delivery of materials to the site.

7. Warranties and Liability
Guarantees: We offer standard warranties against rot and manufacturing defects (typically 10-15 years for treated timber and 5 years for HDPE panels), subject to proper maintenance.

Exclusions: Warranties do not cover damage caused by vandalism, misuse, or "Acts of God" (extreme weather).

Liability: The Company’s total liability for any claim shall not exceed the total price of the goods and services supplied.

8. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
